SILBON CLÁSICO, S.L., (hereinafter SILBON) has developed this Privacy Policy in order to comply with the obligations set out in Regulation 2016/679 of the European Parliament and Council of 27 April 2016 appertaining to the protection of individuals with regard to the processing of personal data and the circulation of this data, hereinafter the RGPD.

Our aim is to let you know the specific aspects related to the processing of your data, among which are: the purpose of the data processing, the contact information for helping you to exercise your rights, the terms of preservation of the information and the security measures we adopt to protect your privacy.

This Privacy Policy is an integral part of the Legal Notice and, as such, the provisions contained herein are applied directly and/or vice versa, complementing each other.

The data that we process

At SILBON we can collect the following personal data: name, surname, address, postal code, locality, province, NIF or NIE, fixed telephone number, mobile number, sex and date of birth. All data is provided by you, either verbally when placing an order or completing a purchase in our stores, or through registration to our website, app or newsletter using the corresponding forms.

Purpose and use of data

We will use your personal data for the following purposes:

  1. Purchases. To manage your purchases, make reservations for products which are unavailable at the time of purchase, bring the contractual relationship to a successful conclusion, etc.
  2. Online store. To manage orders placed through the web, send you information on the delivery status and process product returns.
  3. Customer service. To respond to requests for information, complaints or any other issues that you may raise.
  4. Legal obligation. To comply with all legal obligations derived from the contractual relationship, for example, to perform the billing for the services contracted.

Legitimate Basis for Data Processing and Conservation Period

We will process your data according to the following legitimate bases:

Executing a contract: Your data is necessary for the execution of the contract of sale, so failure to provide this data makes it impossible to provide the service requested (manage orders, make online purchases, respond to your requests for information, etc.). In this case, the data will be kept for the duration of the business relationship.
  2. Legal obligations: At SILBON we have to comply with a series of legal obligations for which the processing of your data is necessary, for example, issuing sales invoices. The data will be kept for the legally required period of time.
  3. Consent: We rely on your consent to send you marketing material (promotions, news, etc.) by email, SMS or other electronic means. This information is kept so long as you do not request its withdrawal. We inform you that you reserve the right to withdraw your consent at any time, without this affecting the legality of the data processing based on the consent given prior to its withdrawal.

Automated decisions and profiling

We inform you that at SILBON we do not perform data processing based on automated decisions, including profiling.

Communication of your data

Entities related to SILBON, which are named as data processing managers, such as accounting and tax consultancies, service providers, maintenance companies, etc., may have access to your personal data.

We can also share your data with administrations and public bodies for the fulfilment of legal obligations (for example to the Tax Agency).

The service providers that we use are located in the European Economic Area, and as such we do not carry out international data transfers.

Rights

You can exercise the following rights:

Right of access

You have the right to obtain confirmation on whether or not SILBON is processing your personal data, as well as to access the following information: the purpose of data processing; the categories of data that are processed; the recipients or categories of recipients to whom the date has been communicated or will be communicated; if possible, the expected period of preservation of personal data or, if this is not possible, the criteria used to determine this deadline.

Right of rectification

You have the right to rectify your personal data when it is inaccurate. You also have the right to complete date that is incomplete. If you are registered on our website, it may be easier to correct it directly by modifying your profile.

Right of erasure (“Right to be forgotten”)

You have the right to have your personal data deleted when the data is no longer necessary for the purpose that it was collected, or when you withdraw your consent and the processing is not based on any other legal basis.

Right to limitation

You have the right to request the limitation of the processing of your data, in which case we will only keep said data for the exercise or defence of claims.

Portability rights

You have the right to receive any data that concerns you in a structured, commonly used and machine-readable format, and to transmit it to another party when the processing is based on consent or a contract and is carried out by automated means. 

Right of opposition

 You have the right to oppose the processing of your personal data when it is subject to processing based on the public or legitimate interest pursued by SILBON, including profiling. In this case, SILBON will stop processing the data, except for in the event of compelling legitimate reasons or for the exercise or defence of possible claims.

Right to file a claim

 You have the right to file a claim with the Spanish Data Protection Agency.
